Glow Gallop — Terms of Service

These Terms of Service govern your access to and purchases from the Glow Gallop online store. By using our site or placing an order, you agree to these terms — please read them carefully.

1. Agreement to These Terms

These Terms of Service (the "Terms") are a binding agreement between you and Glow Gallop ("Glow Gallop," "we," "us," or "our"). They apply to your use of our website, our store, and any order you place with us.

By browsing our site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Returns & Refunds Policy, which are incorporated here by reference. If you do not agree, please do not use the site or place an order.

You must be at least 18 years old, or the age of majority where you live, and able to enter into a legally binding contract to purchase from us. By ordering, you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Products, Pricing, and Orders

We sell LED and lighted gear for horses and riders. We work to describe and show our products accurately, but we do not warrant that product descriptions, colors, images, specifications, or other content are error-free, complete, or current. Actual brightness, color, and appearance may vary with your device, settings, and conditions of use.

All prices are shown in the currency listed at checkout and may change at any time before you place an order. Prices do not include shipping, taxes, duties, or import fees unless stated.

Your order is an offer to buy. We accept your offer only when we send an order or shipping confirmation; until then, no contract exists. We may limit, decline, or cancel any order at our discretion — for example, where an item is out of stock, where there is a suspected error or fraud, or where quantity limits apply. If we cancel an order you have already paid for, we will refund the amount charged.

If a product is listed at an incorrect price or with incorrect information because of a typographical, pricing, or other error, we may cancel or correct the order even after it is submitted, and we will refund any amount you were charged for the affected item.

3. Payment, Shipping, and International Orders

Payments are processed through Shopify and its third-party payment providers. By submitting payment, you authorize us and our providers to charge your chosen payment method for the full order total, including shipping and any applicable taxes or fees. You represent that you are authorized to use the payment method you provide.

We ship to the destinations shown at checkout. Delivery estimates are estimates only and are not guaranteed. Risk of loss and title for products pass to you when we hand the items to the carrier.

We ship internationally where available. If you order from outside the United States, you are the importer of record and are responsible for any customs duties, import taxes, VAT, brokerage fees, and for complying with the laws and regulations of the destination country. These charges are set and collected by your local authorities, are not included in our prices or shipping, and are not refundable by us. If a package is refused, abandoned, or returned because duties or taxes are unpaid, any resulting costs may be deducted from your refund.

4. Returns, Refunds, and Cancellations

Returns and refunds are governed by our separate Returns & Refunds Policy, which forms part of these Terms. Please review it before ordering. In short: eligible items may be returned within 30 days of delivery in unused, original condition, and damaged, defective, or incorrect items must be reported promptly with photos.

If you wish to cancel or change an order, contact us as soon as possible. We will try to accommodate requests made before an order ships, but we cannot guarantee changes once processing or dispatch has begun.

5. Product Safety and Proper Use

Our products are visibility and novelty accessories for horses and riders. They are aids to visibility only. They are not safety equipment, not protective gear, and not a guarantee that you, your horse, or others will be seen or kept safe in any conditions.

You are responsible for using our products safely and lawfully. This includes:

  • Reading and following all product instructions, fit guidance, and care instructions before use.
  • Introducing any new gear to your horse gradually and under supervision, and never leaving a horse unattended while equipped in a way that could cause entanglement, injury, or distress.
  • Checking that lights, straps, and fastenings are secure and in good condition before each use.
  • Following all applicable traffic, equestrian, and local laws, and exercising your own judgment about when and where riding is safe. A lighted product does not make riding on or near roads, or in low light, safe.
  • Keeping batteries and small parts away from children and animals, and charging or replacing batteries only as instructed.

Horses are large, powerful, and unpredictable animals, and riding and handling them carry inherent risks. To the fullest extent permitted by law, you assume all risk arising from your use of our products with animals, near roadways, or in any activity, and you are solely responsible for the safety of yourself, your animals, and others.

6. Intellectual Property

The Glow Gallop name, logo, and all content on our site — including text, graphics, product images, videos, designs, and their selection and arrangement — are owned by Glow Gallop or our licensors and are protected by intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to view and use the site to shop and place orders. You may not copy, reproduce, republish, distribute, modify, scrape, or create derivative works from our content, or use our name, branding, or images, without our prior written permission. All rights not expressly granted are reserved.

7. Your Content and Conduct

If you submit reviews, photos, comments, or other content to us or our site, you grant Glow Gallop a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and adapt that content for marketing and operating our business. You represent that you own or have the right to share what you submit and that it does not infringe anyone's rights or any law.

When using our site, you agree not to: break any law; infringe our or others' rights; upload harmful code; attempt to gain unauthorized access to our systems or data; interfere with the site's operation; or use the site, our content, or our products in any fraudulent, misleading, or abusive way. We may remove content or suspend access for conduct that violates these Terms.

Our store runs on Shopify, and payments, shipping, and some other functions are handled by third-party providers. Your use of those services may also be subject to their own terms and privacy practices. Our site may contain links to third-party websites or resources that we do not control.

We are not responsible for the content, products, services, policies, or practices of any third party, and linking to or using a third-party service is at your own risk. We encourage you to review the terms and privacy policies of any third party you interact with.

9. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, our site and products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

To the fullest extent permitted by law, Glow Gallop and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, injury, or property damage, arising out of or related to your use of the site or products, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the site, the products, or these Terms will not exceed the amount you paid for the product that is the subject of the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including certain rights you may have as a consumer.

10. Indemnification

You agree to indemnify and hold harmless Glow Gallop and its owners, employees, and suppliers from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your misuse of our products, your violation of these Terms or any law, or your infringement of any third party's rights.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of [State], United States, without regard to its conflict-of-laws rules, except where the mandatory consumer-protection laws of your country of residence provide otherwise.

If you have a problem, please contact us first — most issues can be resolved quickly and informally. If we cannot resolve a dispute, you agree that it will be brought exclusively in the state or federal courts located in [County/State], and you consent to the jurisdiction of those courts, unless applicable law gives you the right to bring a claim elsewhere. Nothing here prevents either party from seeking relief in a small-claims court where available.

12. Changes, Severability, and Contact

We may update these Terms from time to time. The current version is always posted on our site with the "last updated" date above, and changes take effect when posted. Your continued use of the site or placing of an order after changes are posted means you accept the updated Terms. The Terms in effect when you place an order apply to that order.

If any provision of these Terms is found to be unenforceable, the remaining provisions stay in full effect. Our failure to enforce any right or provision is not a waiver of it. These Terms, together with our Privacy Policy and Returns & Refunds Policy, are the entire agreement between you and Glow Gallop regarding your use of the site and your purchases.
